In accordance with the provisions in arts. 13 and 14 of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free circulation of these data (in hereinafter, "RGPD"), and articles 6 and 11 of Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights (hereinafter, "LOPDGDD"), by the that the right to information is regulated in the collection of data, we inform you of the following extremes.

Who is responsible for the processing of your personal data?

What personal data do we collect?

The personal data that the user can provide:

  • Name and surname.

  • Email address.

  • Company.

  • Username and password.

  • IP address, date and time of access to COMPANY services

Why and for what do we treat your data?

Depending on the purposes, we will need to process some data or others, which in general will be, depending on the case, the following:

  • Personal data is processed to carry out the provision of training services by the COMPANY

  • The sending of commercial communications to the company that may be of interest to you in the field of …………………...

  • Sending commercial communications to users that may be of interest to them.

What is the legitimacy for the treatment of your data?

The treatment of your data can be based on the following legal bases:

  • Express consent by users in sending commercial communications.

  • Execution of a contract: In relation to the following purposes:

    • The processing of personal data to carry out the training and processing of user data.

  • Legitimate interest in relation to the following purposes:

    • The resolution of errors or user queries related to the operation of the Foxize platform.

    • Any communication that the COMPANY wants to make as long as it is within the framework of the commercial relationship.

  • Compliance with legal obligations to prevent fraud, collaboration with Public Authorities and/or eventual third-party claims.

How long do we keep your data?

The processing of the data for the purposes described will be maintained for the time necessary to fulfill the purpose of its collection, as well as to comply with the legal obligations arising from the processing of the data. Notwithstanding that the conservation is necessary for the formulation, exercise or defense of potential claims; whenever permitted by applicable law.

COMPANY undertakes to cease the processing of personal data when the retention period has ended, as well as to block them duly in our databases.

To which recipients are your data communicated?

In general, the COMPANY will not transfer personal data to third parties, except in those situations in which they can be transferred to collaborators who provide services to the COMPANY, in order to manage the provision of services, the contractual and/or pre-contractual relationship with the interested parties or process requests made by them. In these cases, we ensure that recipients respect confidentiality and have adequate measures in place to protect personal data.

COMPANY transfers personal data to Foxize as it is the platform used to carry out the training. In addition, we attach the following additional information for more information on the treatment of personal data by Foxize.

Data collected by Foxize

Foxize collects all the information entered into the application by the user and stores it on the servers of Foxize's storage provider.

As this is a Cloud service, storage on servers is a requirement for the operation of the application, which is why the user accepts this fact.
Foxize, in its capacity as Processor or sub-processor acting on the instructions of the Customer, shall be authorised to process the Personal Data of the Controller to the extent necessary to provide the Services.

The nature of the operations carried out by Foxize in relation to Personal Data may be in the field of IT, storage or any other similar service.

The Customer determines and controls, in its sole discretion, the type of Personal Data and the categories of Data Subjects.

For what purpose do we treat your personal data?

The Affected Data will be processed for the purposes resulting from the Contract, which consist of:

1.- Identify and relate the user to the products contracted through the customer's cloud

2.- Offer customer service for the management of the platform's products/services.

Foxize will not, under any circumstances, use the data for a purpose other than that intended.

How long will we keep your data?

The personal data provided will be kept for the essential time for the provision of the requested service or marketing of the product and during the legally established periods.

To which recipients will your data be communicated?

The data will not be communicated to third parties except by legal obligation.

How have we obtained your data?

All personal data obtained by Foxize has been advanced directly by the user.

Data security

For Foxize security is the most important thing. Currently the data storage service is carried out through specialized providers with security certificates and anti-hacking systems. Foxize has decided to outsource storage to ensure that the provider meets the highest security standards, at levels that Foxize could not offer on its own storage servers.

Where is your data stored?

What rights do you have and how can you exercise them?

You can direct your communications and exercise your rights by means of a written communication to the following email: ……………………………….

By virtue of what is established by the regulations on data protection, you can request:

  • Right of access: you can request information about the personal data that we have about you.

  • Right of rectification: you can communicate any change in your personal data.

  • Right of deletion and oblivion: you can request the deletion after blocking personal data.

  • Right of limitation to treatment: supposes the restriction of the treatment of personal data.

  • Right of opposition: you can withdraw your consent to the processing of the data, opposing their further processing.

In some cases, the request may be denied if you request that data necessary to comply with legal obligations be deleted. Likewise, if you have any complaint about the processing of data, you can file a claim with the competent data protection authority.

Who is responsible for the accuracy and veracity of the data provided?

COMPANY is not responsible for the veracity of the information that is not produced by itself and for which another source is indicated, and therefore does not assume any responsibility for hypothetical damages that may arise from the use of said information.

COMPANY is exonerated from liability for any loss or damage that the user may suffer as a result of errors, defects or omissions in the information provided by the COMPANY, provided that it comes from outside sources.

What security measures do we apply to protect your personal data?

COMPANY has adopted the security levels of protection of personal data legally required, and tries to install those additional technical means or measures at its disposal to prevent the loss, misuse, alteration, unauthorized access and theft of personal data provided to COMPANY. However, the user must be aware that Internet security measures are not impregnable.

Therefore, COMPANY is not responsible for hypothetical damages that could be derived from interferences, omissions, interruptions, computer viruses, telephone breakdowns or disconnections in the operative functioning of this electronic system, motivated by causes beyond COMPANY's control; delays or blockages in the use of this electronic system caused by deficiencies or overloads of telephone lines or overloads in the Data Processing Center, in the Internet system or in other electronic systems, as well as damages that may be caused by third parties through illegitimate intromissions beyond the control of COMPANY.

How do we use cookies?

COMPANY and Foxize use cookies, in order to optimize and customize your navigation through them. Cookies are physical information files that are hosted on the user's own terminal, the information collected through cookies is used to facilitate user navigation through the portal and optimize the browsing experience. The data collected through cookies can be shared with the creators of the same, but in no case the information obtained by them will be associated with personal data or data that can identify the user. Internal security policy

Security breaches can be caused by employees, third parties or computer errors. Therefore, we are legally obliged to notify data subjects if their personal data has been seriously affected within 72 hours. In addition, users will be notified as soon as the security breach is resolved.
